SWEEPSTAKES ENTRY PERIOD:  The Israel at 75 – Voices, Together Sweepstakes (“Sweepstakes”) begins at 12:00:01 PM Eastern Time (“ET”) on  October 30, 2022 and ends at 11:59:59 PM ET on January 31, 2023 (the “Sweepstakes Entry Period”). 

 

SPONSOR:  Jewish Agency International Development, 633 Third Avenue, 21st Floor, New York, NY 10017, USA (referred to herein as also the “Sponsor” or “The Jewish Agency for Israel”).

 

ELIGIBILITY:  Sweepstakes is open to legal residents of the 50 United States, including the District of Columbia, age 13 or older at time of entry or legal residents of Canada or 19 older at time of entry (collectively referred to hereafter as an “Entrant” or “Entrants”). Employees of the Sponsor, its parent, their manager(s), agents, affiliates, subsidiaries, agents, Ventura Associates International LLC (the “Administrator”), advertising and promotions agencies, crew members connected to the Sweepstakes, and any other individual or company involved in the development or execution of the Sweepstakes ("Released Parties") and their immediate families (parents, siblings, children and their respective spouses) and same households of each, whether or not related are not eligible to enter or win.

 

HOW TO ENTER:  To enter the Sweepstakes, each Entrant must vocally record or provide written lyrics whereby the lyrics or snippets of the lyrics may be used in an upcoming song (“Song”) conveying “What does Israel at 75 means to you.” Important: The lyrics will not be judged and there is no guarantee they will be used when the final recording of the Song is produced, recorded, and promoted to celebrate Israel’s 75th anniversary in 2023. 

 

There are two (2) ways to enter and receive one (1) entry in the Sweepstakes.

Method 1: If offered at a participating event or campaign within the 50 United States or Canada, visit the Sweepstakes Sound Booth (“Booth”) and follow all instructions to register to enter the Sweepstakes during the Sweepstakes Entry Period, vocally record your lyrics for the Song and click on “submit” to receive one (1) entry in the Sweepstakes. 

 

Method 2: Scan the Sweepstakes QR Code or visit https://www.jewishagency.org/voices-together/ (“Website”) during the Sweepstakes Entry Period and follow all onscreen instructions to enter the Sweepstakes, including typing your lyrics for the Song in the appropriate field and click on “submit” to receive one (1) entry in the Sweepstakes.

Regardless of the method of entering the Sweepstakes, there is a limit of fifteen (15) words per Song/entry.

Once you complete and submit your entry, your submission is final and cannot be modified or edited. You may only enter once per day. Limit: Entrants can submit more than one (1) entry. However, each entry must contain different lyrics. Duplicate entries will be disregarded. Entries are subject to all notices posted online including Sponsor’s privacy policy. Multiple entrants are not permitted to share the same email address. All entries, requests and/or materials submitted become the property of Sponsor and will not be returned or acknowledged.

Entries that contain obscenity, copyright or trademark infringement, offensive language, images or symbols, or depictions of a sexual nature, content that is violent or derogatory of any ethnic, racial, gender, religious, professional, or age group, or other inappropriate content (in each case as determined by Sponsor), that are not in keeping with Sponsor’s image, that are otherwise inappropriate, that do not adhere to these Official Rules, as determined by Sponsor in its sole discretion, will automatically be disqualified. Entries that do not include all required information and do not adhere to the foregoing and following requirements will be considered void.

Furthermore, each Entrant acknowledges and agrees that Sponsor may obtain many entry submissions under this Sweepstakes and that such entries may be similar or identical in lyrics, theme, idea, format or other respects to others submitted under this Sweepstakes and/or other promotions staged and/or sponsored by the Sponsor, and waive any and all claims entrant may have had, may have, and/or may have in the future, that any composition, lyrics, entry and/or other works accepted, reviewed and/or used by the Sponsor (or its respective designees) may be similar to his/her entry.  Entrant acknowledges and agrees that neither Sponsor has now, nor shall any of them have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to entrant’s entry. By submitting your entry, you agree that Sponsor has no obligation to publish your entry’s lyrics and that all publication, if any, will be in Sponsor’s sole discretion and that the posting or publication of an entry does not guarantee the entry will be selected as a winning entry in the random drawing.

ASSIGNMENT OF RIGHTS: Entrant (or, if an eligible minor, his/her parent or legal guardian) hereby acknowledges that Entry (including lyrics) and all other materials of every kind whatsoever created by entrant relating to the Sweepstakes including but not limited to as incorporated into Song (collectively, the “Work”) are a “work made for hire” (as that term is used in the United States Copyright Act) for Sponsor, and Sponsor is the sole and exclusive owners, in perpetuity and throughout the universe, of all right, title and interest in and to the Work, including without limitation all copyrights in and to the Work (and all renewals and extensions thereof now or hereafter provided by law) and all the rights therein and thereto, and may exploit the Work (and all rights therein) in any manner throughout the world without restriction on a gratis basis. Without limiting the binding effect of any of the foregoing provisions, in the event that any part of the Work is not deemed to be a “work made for hire” for Sponsor, Entrant (or, if an eligible minor, his/her parent or legal guardian) hereby irrevocably and exclusively grants and assigns to Sponsor (or, if any applicable law prohibits or restricts such assignment, entrant hereby grants to Sponsor an irrevocable, perpetual, royalty-free, transferable license of) on a gratis basis all rights, title and interest in and to such Work, including, without limitation, all rights of every kind and nature (whether now known or hereafter devised, including all copyrights therein and thereto and all renewals and extensions thereof), throughout the universe, in perpetuity, for all purposes, in any and all media, whether now known or hereafter devised.  Entrant (or, if an eligible minor, his/her parent or legal guardian) hereby waives all so-called “moral rights of authors” and “droit moral” rights (and any similar or analogous rights under the applicable laws of any country of the world). Entrants agree and acknowledge that no public performance, synchronization, mechanical, songwriting, publishing and/or master use royalties, monies or consideration of any kind will be payable in connection with Sponsor’s use of the Work, whether commercial use or otherwise, in any and all media, whether now known or hereafter devised.

WINNER SELECTION & ODDS OF WINNING: Potential winner will be selected in a random drawing from all eligible entries received during the Sweepstakes Entry Period. Random drawing to be conducted on or about February 15, 2023, by a representative from the Administrator whose decisions are final and binding. Odds of winning depend on number of eligible entries received during the Sweepstakes Entry Period.

WINNER NOTIFICATION: Winner will be notified via email within three (3) business days after the random drawing is conducted by the Administrator who will require winner to complete, sign and return an Affidavit or Declaration of Eligibility & Release of Liability, and where permissible, a Publicity Release and a W-9 Form  (collectively the “Prize Documents”) and any other required documents request by Administrator within seven (7) business days from date specified on notification, or an alternate winner may be randomly selected at Sponsor’s sole discretion. If winner is a resident of Canada, s/he must correctly answer, without assistance of any kind, a time-limited mathematical skill testing question administered at a mutually agreeable time by telephone. (If the mathematical skill testing question is answered incorrectly, the potential winner will forfeit all rights to  prize and an alternate winner may be selected from all non-winning eligible entries.)  If an email notification is returned as undeliverable three (3) times via email, or if winner fails to execute and return any document required by the Sponsor and/or Administrator within the time allocated, or if winner cannot accept prize for any reason, or if winner is not in compliance with these Official Rules, the winner will be disqualified and at the Sponsor’s sole discretion, the prize may be awarded to an alternate winner from all non-winning entries. Except where prohibited by law, by accepting prize, winner consents to the use of his/her name, photograph, likeness, statement and limited biographical information (city and state of residence) for publicity or advertising purposes in all media worldwide, including, but not limited to social media, without limitation and without further compensation or notice. Furthermore, Sponsor and/or its agents may film, record and/or take photographs of winner taking possession of prize and may use the resulting footage, recordings, or photographs for a range of purposes, including, without limitation, for marketing and promoting Sponsor and/or its promotion partners/agents and their respective products and services. No additional compensation will be provided for any resulting footage.

PRIZE DETAILS AND CORRESPONDING APPROXIMATE RETAIL VALUE (“ARV”): Winner will receive one (1) 3-day trip for two to Israel. Trip includes 3 nights double occupancy hotel accommodations, round trip economy class airfare from the closest commercial airport near winner’s primary residence and $250.00 spending money. ARV of prize: $5,000.00. All meals, ground transportation, taxes, gratuities, incidentals, upgrades, service charges or other expenses not specified herein are not included and are the sole responsibility of winner and guest. If actual value of prize is lower than the stated ARV when prize is procured and fulfilled, then the difference will not be awarded.

Winner must accept prize in its entirety and travel on or about April 23, 2023, or on dates/times as determined by Sponsor or forfeit all rights to prize. Winner will be provided more details on prize after he or she is verified. If winner is a minor, a parent or legal guardian must be winner’s guest. Winner and guest must provide all necessary travel documents required to travel to Israel, such as but not limited to passport. If winner is unable to travel on dates mandated by Sponsor, or after the trip is booked, the winner will forfeit all rights to prize and the Sponsor will have no further obligation to any winner. Sponsor is not responsible for any flight or transportation delay/cancellation, and not liable for any expenses incurred because of such delay/cancellation. Winner will be responsible for all federal, state, provincial and local sales and income taxes on prize won, if applicable. No substitution for any prize or prize portion, except the Sponsor reserves the right, in its sole discretion, to substitute prize (or part thereof) with a different prize of comparable value. Prize is not transferable or redeemable for cash, except in the sole discretion of Sponsor. Winner is not recipient of a prize until he/she/they are verified by the Administrator. Prize details are at Sponsor’s sole discretion. If winner is from the U.S., an IRS form 1099 will be filed in the name of winner for the value of prize won.

The Sponsor will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of, or the restriction of the trip. Furthermore, and with winner’s prior consent, the Sponsor and/or its agents may film, record and/or take photographs of the winner before/during their visit to Israel, and may use the resulting footage, recordings, or photographs for a range of purposes, including, without limitation, for marketing and promoting Sponsor and/or its promotion partners/agents and their respective products and services. No additional compensation will be provided for any resulting footage.

CONSENT AND RELEASE: By participating in the Sweepstakes, Entrants (and their parent(s)/legal guardian(s) if Entrant is deemed a minor in his or her state) release, indemnify and hold harmless the Sponsor, Administrator, and each of their respective parent companies, affiliates, affiliated organizations, subsidiaries, officers, directors, partners, equity holders, agents, employees, and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”) from and against any and all claims, damages or liabilities with respect to, or in any way arising from or relating to such Entrant's participation or attempt to participate in the Sweepstakes, the ability or inability to upload, download or transmit any information in connection to the Sweepstakes and/or the acceptance or use of the prize (if applicable), including without limitation liability for personal injury, damages, death, monetary loss, defamation or violation of privacy rights.

No responsibility or liability is assumed by the Sponsor for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: hardware or software errors, including Booth failures and errors; faulty computer, telephone, cable, satellite, network, electronic or internet connectivity or other online or network communication problems; errors, omissions or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed, incomplete, inaccurate, damaged, destroyed, misdirected or not received or intercepted transmissions; inaccessibility of any website in whole or in part for any reason; traffic congestion on the Internet or any website; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized access, tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of any email; any errors, omissions, interruptions, deletions, defects, delays in operation failures or human error that may occur in the transmission, receipt or processing of entries, or for deletion, theft or destruction of, unauthorized access to, or alteration of, entries; causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes; any entries submitted in a manner that is not expressly allowed under these Official Rules (all such entries will be disqualified); or cheating or fraud by any Entrant. Sponsor is not responsible for any typographical errors, any inaccurate information, whether caused by Entrants, site users, tampering, hacking, or printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; in the announcement of prize or these Official Rules, or any inaccurate or incorrect data contained on any website. Neither Sponsor, nor the Administrator are responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer (hardware or software) and/or other device related to or resulting from participation in the Sweepstakes, or the acceptance or use of prize awarded. The use of third-party software or website or automated entry systems to participate is prohibited, and Sponsor reserves the right to disqualify entries made in such manner. By entering, Entrants agree to comply with these Official Rules. Sponsor is not liable if any portion of the Sweepstakes is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond its control (a “Force Majeure

Event”). SPECIAL CAUTION: COVID-19: In response to economic and/or social conditions caused by COVID-19/Coronavirus, Sponsor may be compelled to cancel the Sweepstakes with little (if any) advanced notice.

 

ARBITRATION: This Sweepstakes shall be governed by and interpreted under the laws of the State of New York, U.S.A. within New York County, without regard to conflicts of law provisions. Entrants hereby agrees that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Sweepstakes shall be resolved, upon the election by Entrant or Sponsor, by arbitration pursuant to this provision and the code of procedures of either the National Arbitration Forum (“NAF”) or the American Arbitration Association (“AAA”), as mutually agreed upon by both parties. Arbitration shall take place in New York County. IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING AND WILL BE LIMITED TO SOLELY THE VALUE OF THE PRIZE. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and Entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and Entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration.

GENERAL: In the event of a dispute as to any Entry, the authorized account holder of the email address used to register will be deemed to be the Entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Winner may be required to show proof of being the authorized account holder to be determined exclusively by the Sponsor’s and/or its agent in their sole discretion.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

SEVERABILITY: If any provision or part-provision of these Official Rules is or becomes invalid, illegal, or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these Official Rules.

 

PRIVACY: Information collected from any Entrant will be processed according to Sponsor’s Privacy Policy at https://www.jewishagency.org/privacy-policy/ including how the data subject rights can be exercised. Any requested opt-in consent is completely voluntary and will not increase your chances of winning. Sponsor does not sell your personal information, as the term “sell” is defined by the California Consumer Privacy Act of 2018.

Entry into the Sweepstakes constitutes your consent to participate in this Sweepstakes and your personal information will be stored on servers located in the United States and will be subject to the laws and authorities of the United States and Canada as well as Sponsor’s privacy policy. Participation in the Sweepstakes implies authorization to collect, process and use the data provided and to transfer such personal data to the United States for purposes of management of the Sweepstakes and future offers for any Entrant that has opted-in to receive such offers. You may unsubscribe at any time. Neither the Sponsor nor its designated agent assumes responsibility for third parties’ failure to act in accordance with Sponsor’s instructions pertaining to the implementation of the Sweepstakes.
